Summary:
Introduction to HeinOnline's Irish Nominative Reports: From the Late Middle Ages through the 17th century, Ireland was subject to two sets of laws, each with their own court systems. Within the confines of the Pale, the area of Ireland centering on Dublin that was under direct English rule, courts were administered according to English law. Beyond the Pale, cases were decided according to Brehon, or Early Irish, law. During this time courts, and court reporters, were largely nomadic in nature, with courts sitting at various locations throughout Ireland. This changed with the centralization of the courts in Ireland, with the construction of the Four Courts in Dublin between 1776 and 1796. Similarly to the English nominative reports, Ireland had no standardized law reporting system prior to 1866. Dedicated series of Irish nominative reports were published for various courts, such as Chancery and Exchequer. In 1866, the Incorporated Council of Law Reporting assumed publication of the Irish reports in two series, one for Equity and one for Common Law. When the separation between common law and equity was eliminated in 1877, these reports merged into one publication. The Irish Reports have been continuously published by the Incorporated Council of Law Reporting for Ireland since 1894. The documents in this collection encompass a period of great transitions in Irish legal society, beginning with the centralization of the courts in the 18th century and the establishment of standardized court reporting in the 19th century, continuing up to the eve of the Easter Rising in 1916. Taken together, these documents provide a fascinating insight into the changing legal system of Ireland in the century before the establishment of the independent Republic of Ireland. About the HeinOnline Collection: HeinOnline's collection of Irish Nominative Reports consists of nominatives covering cases prior to 1894, as well as law reports, which are compilations of notes on cases; and a subcollection of books, digests, and other related works such as notes, periodicals, and treatises.
